This license continues even if you stop using the Services.

Roamer SA is not obligated to publish or retain any User Content and reserves the right to moderate, remove, edit, or restrict access to any User Content at its sole discretion, with or without notice, and for any reason or no reason at all.

If you believe that any User Content posted on the Services infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown request by contacting us at support@roamersa.com. Your request must include all required elements under the DMCA.

Roamer SA is not responsible for and does not endorse any User Content. 24. Binding Arbitration and Class Action Waiver

a. Binding Arbitration:

To the fullest extent permitted by applicable law, you and Roamer SA agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services through final and binding arbitration, rather than in court. This includes disputes arising from or relating to the interpretation or application of this arbitration provision, including its enforceability.

The arbitration shall be conducted by a single arbitrator under the Commercial Arbitration Rules of the American Arbitration Association (AAA) in a location mutually agreed upon by the parties (or in Bexar County, Texas, if no agreement is reached). Judgment on the arbitration award may be entered in any court having jurisdiction.

b. Class Action Waiver:

You and Roamer SA agree that any claims will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.

The arbitrator may not consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

c. Exceptions:

Notwithstanding the foregoing, either party may bring an individual action in small claims court or seek injunctive or equitable relief in a court of competent jurisdiction for claims relating to intellectual property or unauthorized access to the Services.

d. Opt-Out:

You may opt out of this arbitration provision within thirty (30) days of first accepting these Terms by sending a written notice to support@roamersa.com with the subject line “Arbitration Opt-Out” and your full legal name and account email address. Your notice must clearly state your intent to opt out of arbitration.

25. Users in the European Union and United Kingdom

If you are located in the European Union (EU) or United Kingdom (UK), your use of the Services may be subject to the General Data Protection Regulation (GDPR) or UK GDPR.

Roamer SA processes your personal data in accordance with its Privacy Policy, which outlines your rights under applicable data protection laws, including:

All rights, obligations, and liabilities related to the Services are held by CK Group Ventures LLC.
